New Regulations Regarding Exclusion Requests

The Commerce Department published new regulations taking effect on Tuesday that make significant changes in product exclusion requests for the steel and aluminum tariffs.
According to reports, the notice will be published in the Federal Register on Tuesday, Sept. 11. The revised rules allow for comments rebutting industry objections (with 7 days after the 30-day comment period) and for objectors to reply to the rebuttals. There are numerous other refinements.
“Overall, the system should lead to additional exclusions and to decisions issued more promptly than before,” said Washington trade attorney Lewis Leibowitz.
The 171-page notice of “interim” rulemaking will be the subject of forthcoming commentary in Steel Market Update.
